8.1 Subscription Services

8.2 Refund Policy

Refund requests are evaluated on a case-by-case basis. We offer a 30-day money-back guarantee for first-time subscribers. Refunds are not available for renewal subscriptions or after the 30-day period.

9. Disclaimers and Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.

We do not warrant that:

• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like transmitted through the Service by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

Our total liability to you for any claims arising from or related to these Terms or your use of the Service shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless AIV Boost and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Any claim that your Content caused damage to a third party

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
